The Covenants were originally drafted in 1973 and have not been amended since 1980. Federal, state and county laws (including regulatory acts) have superseded specific sections of the CVOA Covenants. The portions which have been superseded are explained and highlighted in green in the “Covenants with Clarification” tab below. Colorado state law requires Associations to adopt policies to clarify Association Covenant intent, assist in their enforcement and follow laws in the Colorado Common Interest Ownership Act.

“Adoption of Policies”
From the CCIOA Required Governance Policies (Posted in Documents) Adopted and Posted 2017: Adoption of Policies Policy: Notice and Comment. A copy of each proposed Policy shall be provided to Owners or posted on the Association’s website. Owners shall be allowed a minimum of 10 days to comment on each proposed Policy. In addition, the Board shall list the adoption of each proposed Policy on the agenda for the Board meeting prior to adoption of said Policies. Any Owner who wishes to comment on a proposed Policy shall be afforded such opportunity at the meeting in compliance with Colorado law.

Policies are based on the CVOA Covenants. Please review corresponding Covenants and the Governance Policies of the Association. The Governance Policies are required by the Statutes of the State of Colorado which govern Common Interest Communities (CCIOA).
